Welcome to Rugged Companion Co. The terms “we,” “us,” and “our” refer to Rugged Companion Co. Rugged Companion Co. operates this store and website, including all related information, content, features, tools, products, and services provided to customers (the “Services”). Rugged Companion Co. is powered by Shopify, which enables us to provide the Services.

These terms and conditions, together with any policies referenced herein (the “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Some products are supplied and shipped by approved third-party suppliers. Product availability and fulfillment times may therefore vary.

When you place an order, you are making an offer to purchase. Rugged Companion Co. may accept or decline an order at its discretion. An order is not accepted until payment has been authorized and we confirm acceptance.

Please review your order carefully before submitting it. We may be unable to change or cancel an order after it has been accepted or sent to a supplier for fulfillment.

If we decline, change, or cancel an order, we will attempt to notify you using the email address, billing address, or telephone number supplied with the order.

You represent that purchases are for personal or household use and are not intended for unauthorized commercial resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged will be the price shown when the order is placed and will appear in the order confirmation.

Unless stated otherwise, displayed prices do not include applicable taxes, shipping, handling, customs charges, or import fees.

Prices on our store may differ from prices offered by suppliers, physical stores, marketplaces, or other third-party sellers.

You agree to provide accurate and current purchase, payment, and account information. You agree to update your information when necessary so that we can complete transactions and contact you.

You represent that you are authorized to use the payment method submitted with an order and that all payment information is accurate.

Products may be shipped directly by third-party suppliers. An order containing products from more than one supplier may arrive in separate packages.

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, severe weather, customs processing, incorrect addresses, supplier delays, or events outside our reasonable control.

These Terms permit you to use the Services for personal, noncommercial purposes. You may not reproduce, distribute, modify, republish, download, store, sell, or transmit store content without written permission, except where permitted by law.

Product names, images, logos, and trademarks supplied by third-party brands remain the property of their respective owners and may be used through approved supplier or retail relationships.

Shopify’s name, logos, product names, designs, and slogans are trademarks of Shopify. Other names, logos, and product names appearing through the Services may be trademarks of their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to tools offered by third parties. We do not necessarily monitor or control these tools.

Third-party tools may be provided “as is” and “as available” without warranties, representations, endorsements, or conditions from Rugged Companion Co.

Your use of third-party tools is at your discretion and may be subject to separate terms and privacy policies. You should review those terms before using the tools.

New store features, tools, and resources may be added in the future. These additions will be considered part of the Services and will be subject to these Terms.

Rugged Companion Co. is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are made directly from Rugged Companion Co.

By using the Services, you acknowledge that Shopify is not responsible for sales between you and Rugged Companion Co., including injury, damage, or loss resulting from purchased products or services. You release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions with Rugged Companion Co.

We may correct errors, update information, or cancel an order when material information is inaccurate, including after an order has been submitted. If we cancel a paid order, the appropriate amount will be refunded to the original payment method.

SECTION 17 – PRODUCT USE AND SAFETY

Customers are responsible for selecting products that are appropriate for their dog’s size, weight, health, temperament, and intended activity.

Product sizing information should be reviewed before purchase. Pet products, including harnesses, leashes, vehicle restraints, travel accessories, and outdoor gear, must be inspected before each use and used according to the manufacturer’s instructions.

No product can eliminate all risks associated with handling, transporting, restraining, or exercising a dog. Stop using a product if it becomes worn, damaged, or unsafe.

Information provided through the store is not veterinary, medical, legal, or professional training advice. Consult an appropriate professional when guidance is needed for your dog’s health, behavior, training, or safety.

SECTION 18 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Rugged Companion Co., its service providers, contractors, licensors, suppliers, and Shopify and its affiliates will not be liable for indirect, incidental, punitive, special, or consequential damages arising from access to or use of the Services or products purchased through the Services.

This includes, where permitted by law, lost profits, lost revenue, lost savings, loss of data, replacement costs, and similar damages.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

SECTION 19 – INDEMNIFICATION

You agree to indemnify and hold harmless Rugged Companion Co., Shopify, and their respective affiliates, partners, employees, contractors, licensors, suppliers, and service providers from third-party claims or losses arising from your material breach of these Terms, violation of applicable law, infringement of another party’s rights, or misuse of the Services.

This obligation applies only to the extent permitted by law.

SECTION 20 – SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed from the Terms. The remaining provisions will continue in effect.

A failure to enforce a provision of these Terms does not waive the right to enforce it later.

To the extent permitted by law, disputes will be handled in courts having jurisdiction in or serving Montezuma County, Colorado.
